But in doing so, it&#8217;s entirely agnostic as to whether Democrats, Republicans, Greens, Libertarians, etcetera, are identified The sweep looks for behavior, not people or affiliation.</p></div><p style="text-align: justify;">As of sweep close, Xavier Becerra is projected by the Associated Press (AP) and NBC News to advance to the general election in the governor&#8217;s race. The second-place contest between Steve Hilton and Tom Steyer remains unresolved, with more than three million ballots statewide still to be counted. The mail ballot receipt deadline &#8212; the last day ballots postmarked by June 2 can legally arrive &#8212; is <strong>June 9: two days away.</strong> That deadline is the nearest and most critical escalation trigger in the Warning Set.</p><p><strong>Why Does the Tip Line Matter &#8212; And What Else Is the Warning Set Tracking?</strong></p><p style="text-align: justify;">The establishment of a public tip line by a sitting United States Attorney during an active canvass is significant for four reasons. <em>First</em>, it transforms the investigation from a press announcement into ongoing operational activity: any California resident can now submit a complaint directly to federal prosecutors while ballots are still being counted. <em>Second</em>, it creates a formal mechanism through which the Hilton campaign or other Republican actors could file complaints that might later be used as legal grounds to contest the election results. <em>Third</em>, it extends the federal investigative posture through the entire canvass period, potentially through the July 3 county deadline. <em>Fourth</em>, election workers throughout California now know that their actions may be reported to federal law enforcement by members of the public, a dynamic that can discourage normal, lawful canvass operations &#8212; a &#8220;chilling effect&#8221; on the people responsible for counting the votes.</p><p style="text-align: justify;">Beyond California, the Warning Set is simultaneously tracking several other active concerns. The Associated Press (AP) and several other major news outlets noted that Essayli&#8217;s announcement &#8220;seemed to be in response to&#8221; Trump&#8217;s social media posts and that Trump &#8220;did not provide evidence&#8221; for his claims. The Los Angeles County District Attorney&#8217;s office &#8212; the local prosecutorial authority that would normally be the lead agency for election crimes in that county &#8212; stated it had received no complaints from federal authorities about election misconduct. On the same day, Essayli also confirmed that his office is coordinating with Harmeet Dhillon, the Assistant Attorney General (AAG) for the Civil Rights Division at the Department of Justice (DOJ), to conduct a &#8220;comprehensive audit of California&#8217;s voter rolls&#8221; &#8212; linking the fraud investigation to a broader DOJ campaign targeting voter registration lists in approximately 30 states. Dhillon, a political appointee with a public record of partisan positions on California elections, responded to Essayli&#8217;s post by writing &#8220;Teamwork/dreamwork.&#8221;</p><p><strong>THE VOTE COUNT AND WHY IT MATTERS TO THE ESCALATION RISK</strong></p><p style="text-align: justify;">California&#8217;s primary election for governor was held June 2, 2026. The second slot &#8212; between Hilton and Steyer &#8212; remains unresolved, with more than 3.6 million ballots still to be counted statewide and over 713,000 in Los Angeles County alone. Mail ballots in California tend to favor Democratic candidates, which means Steyer could continue to gain on Hilton. If Steyer eventually overtakes Hilton and the final advances are Becerra and Steyer &#8212; an all-Democrat general election &#8212; the Warning Set assesses that as the highest escalation-risk outcome: it would mean Trump&#8217;s preferred Republican candidate, Hilton, was eliminated entirely from the race by mail ballots after Trump publicly alleged those ballots were fraudulent. The federal investigation announcement on June 5 coincided almost exactly with the moment Becerra took the lead.</p><p><strong>THE BROADER CONTEXT: COURTS, POSTAL RULES, AND FEDERAL PERSONNEL</strong></p><p style="text-align: justify;">The California investigation did not happen in a vacuum. The Warning Set tracks 14 categories of election security indicators simultaneously, and several are directly connected to what happened June 5. First: a federal court in Boston. U.S. District Judge Indira Talwani has been considering a lawsuit challenging Executive Order (EO) 14399, which would require the U.S. Postal Service (USPS) to restrict mail ballot delivery to voters on federally verified lists. That date is now a two-track convergence point.</p><p><strong>WHAT TO WATCH: THE HIGHEST-RISK WINDOW IS NOW</strong></p><p style="text-align: justify;">The Warning Set has assessed the period from June 6 through June 9 &#8212; the California mail ballot receipt deadline, the last day ballots postmarked by June 2 can arrive and be counted &#8212; as the highest-risk window in the project&#8217;s monitoring history. During this window, each new count batch that extends Becerra&#8217;s lead, or shows Steyer gaining on Hilton, carries fresh escalation risk in the form of additional presidential social media activity, additional USAO statements, or formal legal challenges to the canvass by Hilton&#8217;s campaign or allied Republican groups. The Warning Set is monitoring for: whether Essayli&#8217;s office takes any further steps beyond the June 5 announcement, including additional AUSA visits to county ballot-processing facilities, subpoenas to election officials, or additional public statements; whether California Attorney General Rob Bonta takes legal action in response to Essayli&#8217;s announcement (he has previously petitioned the California Supreme Court to halt a sheriff&#8217;s ballot seizure attempt in Riverside County); whether Judge Talwani issues her ruling in Boston and whether that ruling directly addresses Essayli-type prosecutorial action; and whether any foreign state actors &#8212; Russia, Iran, or China &#8212; amplify the investigation announcement to reinforce narratives of U.S. electoral illegitimacy. That is normal: California uses universal vote-by-mail, and mail ballots legally postmarked by Election Day can arrive through June 9. Multiple news organizations have confirmed this is how the system is designed to work. But President Trump posted on his Truth Social platform in the early hours of June 3 claiming that Democrats were &#8220;stealing&#8221; the governor&#8217;s race and that the California vote was &#8220;under investigation&#8221; by the U.S. Attorney&#8217;s Office in Los Angeles. That investigation claim has not been confirmed by any source. When asked directly, the U.S. Attorney&#8217;s office said only &#8220;no comment&#8221; &#8212; which is not a denial. The lead prosecutor in that office, First Assistant U.S. Attorney Bill Essayli, is a Trump political appointee. California&#8217;s Democratic Party chair called the claims baseless; Governor Newsom&#8217;s office put out a video explaining how mail ballot counting works; Democratic candidate Xavier Becerra posted that &#8220;the voters decide who leads California &#8212; not you.&#8221; Meanwhile, Decision Desk HQ, a nonpartisan election projection service, has projected that Becerra will advance to the November general election &#8212; meaning he is expected to overtake Republican candidate Steve Hilton as the remaining mail ballots are counted. Each new batch of ballots showing Becerra gaining ground is likely to generate fresh presidential posts. The next four days, through the June 9 ballot receipt deadline, are considered the highest-risk window for further escalation.</p><p>In the courts and in Congress, several fights over the rules of voting itself are unfolding simultaneously. A federal judge in Boston, Judge Indira Talwani of the U.S. District Court for the District of Massachusetts, heard arguments three days ago on whether to block a Trump executive order that would require the U.S. Postal Service to restrict mail ballot delivery to voters whose citizenship has been verified through federal lists &#8212; lists that experts say are incomplete and that the government&#8217;s own lawyer acknowledged are imperfect. The judge signaled serious concern at that hearing, asking whether voters would &#8220;reasonably fear&#8221; being turned away. A ruling could come any day, or take weeks; if she blocks the order, the administration is expected to seek an emergency override from higher courts. Separately, thirteen Democratic senators sent a formal letter to Commerce Secretary Howard Lutnick demanding that his department stop any involvement in implementing that same executive order and preserve all records for congressional oversight. The letter cites reports that Lutnick played a key role in drafting the order &#8212; which is unusual, since the Commerce Department has no legal authority over the Postal Service or elections. Lutnick has a June 15 deadline to respond. His department ignored a previous Senate letter on a related topic, and if he ignores this one, senators have grounds to begin formal oversight proceedings. At the same time, a separate executive order signed June 3 reclassified roughly 8,000 senior federal workers &#8212; the kinds of officials who oversee voting rights enforcement and election security programs &#8212; as at-will employees who can be fired at any time without cause. Federal union lawyers have already filed suit to stop it.</p><p>Two longer-running concerns round out the picture. The first involves a phone app that the White House has required every executive branch employee to install on their government-issued device. Security researchers have found that the app contains code capable of activating GPS tracking &#8212; it is not currently confirmed as active, but the capability is there and can be switched on remotely. The app was deployed without the security review the federal government normally requires before installing software on government systems. No federal cybersecurity agency has publicly responded to these findings, and no congressional action has been taken. The second involves a discrepancy found in government website records suggesting that the administration may have made a representation to a federal court about when certain work on federal election infrastructure began that does not match the technical evidence &#8212; a finding that remains based on a single source and has not yet been independently confirmed by major news organizations. What Trump described as suspicious &#8212; votes arriving and being counted after Election Night &#8212; is in fact how California&#8217;s mail ballot system is designed to work. California is one of eight states where every registered voter automatically receives a mail ballot; those ballots are valid as long as they are postmarked by Election Day and arrive within seven days. The count is expected to continue for weeks, and it is normal. Florida Governor Ron DeSantis amplified Trump&#8217;s posts on the social media platform X, calling California&#8217;s counting &#8220;pathetic&#8221; and &#8220;corrosive to our civic culture,&#8221; and asking whether the delay was &#8220;incompetence or intentional.&#8221; Analysts tracking this situation flag it as a serious warning sign: a narrative accusing an ongoing legitimate vote count of fraud &#8212; promoted by the president and echoed by other major political figures &#8212; is exactly the kind of claim that, if it leads to formal federal action, could interfere with the counting and certification of ballots.</p><h3><strong>A Federal Court Ruling That Could Change November &#8212; Still Pending</strong></h3><p>One of the most consequential legal decisions of the 2026 election cycle is sitting on a federal judge&#8217;s desk in Boston. U.S. District Judge Indira Talwani held a hearing on June 2 on challenges to Executive Order 14399, which directs the U.S. Postal Service (USPS) to restrict mail ballot delivery to voters on a federally verified list and sets up a federal citizenship verification system for elections. States and voting rights groups argue the order unconstitutionally overrides state control of elections. Security researchers had already flagged the app&#8217;s privacy problems when it launched in March: it contains hidden code capable of tracking users&#8217; precise location every few minutes, can receive silent updates without going through Apple or Google review, and sends user data to a string of commercial third parties instead of government servers &#8212; all while its official privacy disclosure to Apple declared zero data collection. None of the standard federal security review processes (known as FedRAMP) appear to have been completed before the mandatory rollout. The federal cybersecurity agency CISA, which received a security research report on March 27, has issued no public response. This is no longer just a concern about a consumer app: it&#8217;s now a question about surveillance architecture being deployed across the entire executive branch.</p><p>On the mail-voting front, two major developments are converging. A federal judge in Boston, Massachusetts &#8212; Judge Indira Talwani &#8212; held a hearing on June 2 in a lawsuit brought by 24 state attorneys general seeking to block President Trump&#8217;s executive order restricting mail ballot delivery. That ruling has not yet been issued, and when it arrives it will be the most significant legal decision in the Warning Set&#8217;s operational history. Separately, the U.S. Postal Service (USPS) formally published its proposed rule implementing the executive order in the Federal Register on June 2, opening a 30-day public comment period. The rule would require states to submit lists of mail ballot requesters and give USPS the authority to reject non-conforming ballot mailings &#8212; a mechanism that, combined with a recent Supreme Court decision eliminating the main legal remedy for deliberate mail ballot suppression, creates a system the Warning Set has rated at its highest alert level.</p><p>The California primary itself passed a basic threshold test: polls opened and closed without confirmed federal agent interference, and the state&#8217;s law restricting unauthorized law enforcement access to polling places (Senate Bill 73) appeared to deter any such incidents. Early results show former Health and Human Services Secretary Xavier Becerra and Republican commentator Steve Hilton leading in the governor&#8217;s race, with billionaire Tom Steyer competitive for the second general-election slot. But the full picture won&#8217;t be clear until mail ballots are counted through June 9. Two pre-election incidents &#8212; ballots found burned inside a Los Angeles County drop box, and vandalism at a Long Beach vote center on May 31 &#8212; remain under active investigation with no arrests made. The Warning Flag is a companion newsletter to Conscience of A Whig.  As you&#8217;ll see, it is quite different, and a passion project of mine and a team of colleagues. </p><p>About a month ago, I and some colleagues were discussing whether an Indications and Warning approach could be applied to Election Security issues. Intrigued, I decided to give it a try. My first step was creating a list of events I thought would be likely indicators. One of my colleagues suggested using a Large Language Model to scour news sites for evidence of electoral shenanigans. Having shortly before begun experimenting with Anthropic&#8217;s Claude, and with an assist from another colleague who drafted a system prompt, I gave it a whirl. The results were quite impressive. Not only did I get a rich return of data, Claude even formatted the  and information for me, after an extended &#8220;conversation&#8221; regarding preferences.</p><p>So for the last month I and my colleagues have been experimenting with a product I&#8217;ve dubbed a Daily Sweep; Claude does an initial analytic take on the events they&#8217;re identified, then I review the report, assess the sourcing and validity and make further inquiries if indicated. I&#8217;ve tried variations on prompts, testing the process to ensure I am not instilling biases, and finding a work pace as well as developing a product that serves peoples&#8217; needs. At least I hope the product serves peoples&#8217; -- your -- needs.</p><p>Before going further, I want to stress a key point. The Warning Project process is non-partisan. Nowhere in the system prompt that&#8217;s in use is there mention of political parties or political actors, nor will there be. The output will mention political parties and actors should Claude capture the information in the daily sweeps. But in doing  so, it&#8217;s entirely agnostic as to whether it&#8217;s Democratic, Republican, Green, Libertarian, etcetera. The sweep looks for behavior, not people or affiliation.</p><p>For this first outing, I am providing Daily Sweep results for June 1st and 2nd. Going forward I will try to post Daily Sweep results on a daily basis.  I am also providing two <em>Interim Warning Notifications</em> that address issues brought to my attention that I deemed warranted consideration. NSA/Cyber Command Director Rudd testified that foreign adversaries are &#8216;reasonably expected&#8217; to target 2026 elections. CDT&#8217;s &#8216;Fractured Shield&#8217; report (May 28) documents the collapse of federal-state-local cyber information-sharing pipelines. The FY2027 budget would eliminate CISA election security program funding entirely. 75% of local election officials report no additional state/local resources to backfill the federal gap.
